General Rental Conditions

The Lessor rents to the Lessee the vehicle described in the rental agreement, under the terms and conditions set forth on the front and back of this rental agreement, which the Lessee accepts and agrees to abide by.

Article 1: Use of the Vehicle

The Lessee agrees to:

  • Use the vehicle in a prudent manner.
  • Use the vehicle in compliance with the Wallis and Futuna Highway Code.
  • Use the vehicle lawfully and for legitimate purposes.
  • Use the appropriate fuel.
  • Lock the vehicle when not in use and ensure that all windows, sunroofs, removable roof panels, or convertible tops are properly closed.
  • Stop using the vehicle immediately, subject to preserving your safety, and inform us immediately of any defect found on the vehicle.

The Lessee agrees not to allow the vehicle to be driven by persons other than himself/herself or those approved by CORAIL RENTING and for whom he/she is responsible, in accordance with Article 1384 of the Civil Code. The Lessee also agrees that the vehicle will not be used:

  • For the paid transport of passengers, regardless of the method of payment chosen and regardless of the written or verbal agreement.
  • To propel or tow any vehicle or trailer or any other object, whether rolling or not.
  • In competitions.
  • By any person under the influence of alcohol or narcotics.
  • For illegal purposes or for the transport of goods.
  • In an overloaded condition, with the rented vehicle carrying a number of passengers exceeding that indicated on the registration document.

In addition, the vehicle may only be driven by persons designated on the front hereof, subject to the prior authorization of the Lessor and provided that such persons are at least 22 years of age and hold a valid driver’s license for at least three years.

The Lessee agrees to keep the said vehicle closed and locked outside of periods of use, keeping the registration documents with him/her, which shall in no case be left on board.

The Lessee shall in no case assign, sell, mortgage, or pledge this contract, the vehicle, its equipment, or tools, nor treat them in a manner that may harm the Lessor. Any breach of any of these commitments authorizes the Lessor to require the Lessee to return the vehicle without delay, without being liable for any justification or compensation of any kind.

The rented vehicle is only authorized to circulate on roads open to motor vehicle traffic, public or private, on the sole island of FUTUNA.

Article 2: Accident Report

Any damage caused to the rented vehicle must be the subject of an immediate accident report by the Lessee, either by amicable report or by calling the Gendarmerie at 17. The Lessee who does not comply with this commitment is, except in cases of force majeure, presumed responsible for the damage and its consequences, and the same applies if his report does not identify the person responsible for the damage.

Article 3: Damages Chargeable to the Lessee

Damages caused intentionally, by malice or inexcusable fault, damages caused in particular in the event of crossing watercourses, penetration into seawater, sinking, overturning of the vehicle, driving on non-drivable roads, failure to present the vehicle for the monthly technical inspection, punctures, blowouts or tears of tires, damage caused while driving under the influence of alcohol, or after use of narcotics, or by any passenger causing them under the influence of such a condition.

Damages caused when the driving of the vehicle has been ceded to a third party not designated in this rental agreement.

Article 4: Maintenance – Repairs

The Lessor agrees to provide you with a vehicle in good apparent condition and to carry out repairs, replacement of parts or tires resulting from normal wear and tear. The Lessee agrees to maintain the vehicle as a “responsible person” and in particular, to check the levels of water, oil and all fluids as well as the tire pressure.

The Lessee agrees to present the vehicle once a month to: CORAIL RENTING for a technical inspection.

Repairs, replacement of parts or supplies resulting from abnormal wear and tear, negligence or accidental cause remain at your expense. In the event of deterioration of one of the tires other than normal wear and tear, the Lessor will charge you for a new tire.

Article 5: Fuel

Fuel is the sole responsibility of the Lessee. You must return the vehicle with the same amount of fuel as at the time of collection (as indicated on the front). Otherwise, you will have to pay for the fuel consumed at the CORAIL RENTING rate in effect.

Article 6: Return of the Vehicle

Unless otherwise agreed, you must return the vehicle and all optional products at the times, date, and place agreed in the rental agreement. Any delay will result in an additional day’s charge. If you think you will be late, please notify the agency as soon as possible.

The vehicle must be returned in a clean condition. If the Lessor considers that the vehicle is abnormally dirty, it reserves the right to charge for the cleaning at a minimum price of 6,900 FCFP.

Article 7: Duration – Extension – Payments

The rental of the vehicle is concluded for a specific period expressly stipulated in the contract. Its extension can only be validly made by way of an amendment signed between the Lessee and CORAIL RENTING before the expiry of the contract. The fact of taking charge of the rented vehicle commits the Lessee to bear the minimum daily rate, whatever the brevity of the charge.

The Lessor reserves the right to refuse the extension of the rental without compensation for the Lessee, with the obligation for the latter to1 return the vehicle immediately.
